Piratbyrån har onekligen en viss poäng i sitt senaste utspel:

Att vara för eller emot fildelning nu, 2007, är lika meningsfullt som att vara för eller emot kolföreningar.

  • Som Piratbyrån själva säger; "när Piratbyrån startade för fyra år sedan, fanns inte den diskussion som finns idag – det fanns antipirater vars ord fick stå oemotsagda".

    Idag är läget ett annat, det finns andra som kan ta och tar debatten om legaliteten (Piratpartiet inte minst). Därför kan byrån släppa den frågan för att fokusera på annat t.ex. vilka effekter som fildelning/kopiering har etc.

  • Ja, att vara för eller emot "fildelning" är som att välja mellan att vara för eller emot kommunikation. Antingen kan folk kommunicera digitalt, eller så kan man det inte, något mellanting finns inte och vad som än kommuniceras så består det av samma sak, långa binära tal - ettor och nollor.

    I nästa logiska steg ligger då att det inte går att skilja på lovlig och icke-lovlig kommunikation utan att ta del av densamma, verket uppstår ju först hos betraktaren. Vilket då leder till avlyssning av folks privata kommunikation redan utan reell brottsmisstanke. Så är man för kommunikation och samtidigt emot "fildelning" så gör man ofelbart det logiska misstaget som slutar i brott mot folkrätten, ett avskaffande av rätten till _privat_ kommunikation och meningsutbyte.
